IN THE HIGH COURT OF DELHI AT NEW DELHI
+ W.P.(C) 7639/2015 &CM No.14885/2015 (for stay) MINDMILL SOFTWARE LIMITED ..... Petitioner Through:
Mr. Abhijat and Ms. Dakshaa Arora, Advs.
versus NATIONAL MINORITIES DEVELOPMENT AND FINANCIAL CORPORATION ..... Respondent Through:
Mr. Danish Z. Khan, Adv.
CORAM:
HON'BLE MR. JUSTICE SANJEEV SACHDEVA
O R D E R
% 15.09.2016 The petitioner impugns the order dated 10.04.2015 whereby the respondent had blacklisted the petitioner. The petitioner also impugns the action of the respondent in informing the sister concerns of the respondent about the decision of blacklisting the petitioner. Learned counsel for respondent submits that in view of the conduct of the petitioner, the respondent had only decided to blacklist the petitioner and in fact blacklisting order has not been passed. He submits that there is no final decision to blacklist the petitioner and the letter dated 10.04.2015 only indicates contemplation of an order but in fact the petitioner had not been blacklisted. In view of the submissions of the counsel for the respondent that there is no blacklisting order of the petitioner, the petition is W.P.(C) 7639/2015
disposed of holding that the letter dated 10.04.2015 does not amount to an order of blacklisting of the petitioner. The respondents are further directed to inform the sister concerns, whom the respondent had earlier informed, that there is no order of blacklisting of the petitioner and the letter dated 10.04.2015 is not an order of blacklisting. The petitioner shall be issued the copy of the letter sent to the sister concerns in the above terms.
The petition is disposed of in the above terms with no order as to cost.
