O R D E R

% 20.12.2016 CO.APPL. 5097/2016 The present joint application filed on behalf of the parties, under Order XXIII Rule 3 read with Section 151 of the Code of Civil Procedure, 1908 and Rule 9 of the Companies (Court) Rules, 1959 prays as follows:- "It is, therefore, most respectfully prayed that under the facts and circumstances of the case and in the interest of justice, the application filed by the parties may kindly be accepted and the petition may kindly be disposed of as compromised and satisfied and the parties be left to bear their own costs.

Any other of further relief which this Hon'ble Court may deem just, fit and proper be also passed."

Learned counsel appearing on behalf of the petitioner states that the underlying dispute that led to the institution of Co.Pet 645/2015 has been amicably settled by and between the parties with the aid and assistance of the Delhi High Court Mediation and Conciliation Centre vide Settlement Agreement dated 09.09.2016.

A copy of the said Settlement Agreement Dated 09.09.2016 is on record.

The said Settlement Agreement dated 09.09.2016 is lawful and the parties shall abide by the terms and conditions of the said Settlement Agreement dated 09.09.2016 without demur.

Learned counsel appearing on behalf of the petitioner states that in terms of the aforesaid Settlement Agreement dated 09.09.2016 they have received a sum of Rs.18,00,000/- in full and final settlement of their dues and, therefore, prays that the company petition be disposed of as having been settled. In view of the foregoing, the present application is allowed. The Co.Pet. 645/2015 is disposed of as having been settled. Pending applications, if any, also stand disposed of. The interim order dated 19.02.2016 passed by this Court stands vacated. The date already fixed, i.e., 24.01.2017 stands cancelled. SIDDHARTH MRIDUL, J DECEMBER 20, 2016 mk
