% 19.04.2016 I.A. No.4703/2016 At the outset, learned counsel for the defendant has tendered in court the duly attested affidavit of defendant no.1 in support of the application. The same is taken on record.
This application has been jointly moved by the parties under Order 23 Rule 3 CPC to record their settlement. The application is signed by the representatives of the parties and their respective counsels, and is also supported by the affidavit of Mr. Sunil Sharma, the authorised signatory of the plaintiff as well as the affidavits of defendant nos.1, 2 and 3.
The terms of the settlement appear to be fair, just and reasonable and I see no impediment in accepting the same. Accordingly, the suit is decreed in terms of prayers (a) and (b) made in para 31 of the plaint. The parties are left to bear their respective costs.
