Four posts :
(i) Constable, (ii) Head Constable, (iii) Assistant Sub Inspector, and (iv) Sub Inspector have been merged in one writ petition creating problem in adjudication.
The applicability of Schedule-A to the Revised Pay Rules, 2008 of the Indian Railways falls for consideration with reference to the fact that where a post has an element of direct recruitment minimum basic pay in the applicable pay band is prescribed under Section II to Schedule-A of the Revised Pay Rules, 2008, promulgated by the Indian Railways. The pleadings are vague and confusing. 2.
Learned counsel for the petitioners prays for and is granted leave to withdraw the writ petition with right reserved to file fresh petition on the same cause but by filing separate petitions for Constables, Head Constables, Assistant Sub Inspectors and Sub Inspectors.
