O R D E R

% 09.10.2019 The present petition has been preferred by the petitioners to seek the following reliefs:

"i. Issue an appropriate writ, order or directions declaring the entire acquisition proceedings in respect of the land of petitioners comprised in Khasra no. 187 (6-14) total admeasuring 6 bighas and 14 biswas, situated in Revenue Estate of village Lado Sarai, New Delhi under the Land Acquisition Act, 1894 to have lapsed in view of Section 24 (2) of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Re-settlement Act, 2013. ii. Pass any further order/s that this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case."

The acquisition of the land in question was notified under Section 4 of the Land Acquisition Act on 13.11.1959; followed by declaration under Section 6 of the said Act on 16.05.1966; and the LAC rendered the Award bearing No. 36-D/1980-81 Supplementary in the year 1980-81. The present petition has been filed only in August 2017 premised on Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Evidently, the petition is barred by gross delay and laches.

Learned counsel for the petitioners, on instructions, seeks leave to withdraw the writ petition with liberty to file afresh after explaining the delay and laches.
