% 10.10.2017 Petitioner approached this Court alleging illegal and unauthorized construction in property bearing No. J-3/116, J-Extn., Laxmi Nagar, Delhi -110092. In the status report that has come to be filed on behalf of the respondent-EDMC, inter alia, it is stated as follows :

"7.

That, it is further submitted that Sh. Shahid Siddiqui also moved an application for regularization of the structure over the property in question. The regularization application has also been rejected on 03.10.2016. The copy of the rejection letter dated 03.10.2016 is annexed as Annexure R-IV. 8.

That, it is further submitted that the demolition order dated 12.03.2010 was challenged before the Hon'ble ATMCD vide appeal no. 268/2016 titled as Shahid Siddiqui Vs EDMC. The Hon'ble Appellate Tribunal vide its order dated 02.12.2016 has restrained EDMC for carrying out the demolition action and the above restrained orders has been extended till next date of hearing i.e. 09.11.2017. The copy of order dated 02.12.2016 & 07.07.2017 annexed as Annexure RV Colly." In view of the afore-going, nothing survives in the instant

petition.

Petition and the pending application are disposed off accordingly.

Liberty is however, reserved to the petitioner to approach this Court afresh, if, a fresh cause of action arises. A. K. CHAWLA, J OCTOBER 10, 2017 rc
