% 29.01.2016 Respondent has filed his reply. It is an admitted fact that a divorce petition is pending before the Principle Judge, Family Court, Dwarka and before the Karkardooma Court a petition under Section 125 Cr.P.C. is pending. The petitioner before this Court is the estranged wife. She prays that the divorce petition pending before Principle Judge Family Court, Dwarka Courts be transferred to the Principle Judge Family Court, Karkardooma Courts and both the petitions should be decided by the same Presiding Officer to avoid conflict of judgment. It is an admitted position that both these petitions have to be tried by a Family Court to avoid conflict of judgments. Accordingly, Divorce Petition No.261/2015 titled Hemant Kumar Vs. Preeti Rani pending before the Principle Judge, Family Court, Dwarka be transferred to the Court of the Principle Judge, Family Court, Karkardooma Courts where the petition under Section 125 Cr.P.C. (filed by the wife) is pending.
Parties are directed to appear before the Principle Judge, Family Court, Dwarka Courts on 17.3.2016 who will pass appropriate orders. Petition disposed of.
