% 01.11.2018 After some hearing, the learned counsel for the petitioner submitted that he may be permitted to withdraw the captioned petition and the applications filed therewith as the petitioner undertakes to appear in person without any further default before the Metropolitan Magistrate tendering apology for the defaults in appearance in the past though on account of his medical condition, assuring that he will hereafter abide by the directions and cooperate with the trial court for expeditious further proceedings.
The petition and the applications filed therewith are dismissed as withdrawn. Needless to add, while considering the prayer for cancellation of the duress process for which the petitioner intends to move an appropriate application, the Metropolitan Magistrate will bear in mind the nature of the offences involved.
