% 06.05.2016 I.A. No. 5606/2016 The suit stands disposed of as settled on 30.11.2015. The defendant made payment of Rs.45 lacs to the plaintiff under the settlement. The plaintiff gave up his rights in the suit property in view of the said settlement. When the suit was listed on 24.08.2015, the court directed the plaintiff to deposit the balance sale consideration within four weeks in this court. Accordingly, the plaintiff states that he deposited Rs.24 lacs. By this application, the plaintiff seeks refund of the said amount along with accrued interest thereon. The application is allowed. The registry is directed to prepare a pay order in the name of the plaintiff for the entire amount lying in deposit in terms of the order dated
24.08.2015. The pay order may be delivered to learned counsel for the plaintiff.
The application stands disposed of.
