% 06.10.2015 The present petition was filed by Raju @ Rama Kant Rao seeking protection to him and his family members.

It has been averred in the petition that Raju @ Rama Kant Rao was on inimical terms with one Ajay @ Chotu. Earlier an attempt on the life of Raju @ Rama Kant Rao was made by aforesaid Ajay @ Chotu when an FIR No.1073/2014 was lodged by Raju @ Rama Kant Rao. Ajay @ Chotu was murdered while he was in judicial custody. Thereafter, as has been stated in the petition, the wife of Ajay @ Chotu started threatening Raju @ Rama Kant Rao and his family members. It was under such circumstances that the present writ petition was filed.

During the pendency of the present writ petition, Raju @ Rama Kant Rao was also murdered. In the FIR which was lodged for the murder of the

petitioner, almost all the accused persons have uptil now been arrested. Be that as it may, a prayer was made by the wife of late Raju @ Rama Kant Rao vide Crl. M.A.13644/2015 for substituting her as the petitioner in the present case.

The applicant would have been well advised to withdraw this petition in order to enable her to prefer a fresh petition, if so advised, for redressal of her grievances and needful.

Mr.Haq, learned advocate seeks permission to withdraw this petition in order to enable him to prefer a fresh petition on behalf of the wife of late Raju @ Rama Kant Rao.

Permission accorded.

The writ petition and the application are dismissed as withdrawn with the liberty aforesaid.
