% 14.12.2017 As per the affidavit filed by the first respondent, tax deducted at source ('TDS') on payments made under the Voluntary Retirement Scheme was deposited with the Income Tax Department, between 7th November, 2016 and 26th May, 2017. The present writ petition was filed on or after 28th July, 2017.
Details of the TDS deducted have been enclosed at pages 91 and 92 of the writ petition which indicates the PAN No. of 60 petitioners and amount of TDS.
During the course of hearing, it is stated by the counsel for the petitioners that the petitioners were advised to file return of income seeking
refund. Apparently, many of the petitioners' have filed their returns. In case some of them have not filed return they can do so till 30th March, 2018 as per law.
The returns of income filed will be processed and accordingly issue of refund would be examined and granted.
We hope and trust that the Central Processing Unit/ Assessing Officer would expeditiously process the returns filed by the petitioners and accordingly issue the refund orders.
With the aforesaid observations, the writ petition is disposed of. No Costs.
