O R D E R

% 30.08.2017 Petitioners allege unauthorised construction being raised in properties bearing no. 745, Main Market, Rani Bagh, Shakur Basti, Near SBI Bank Shakur Basti, Delhi - 34 and 25, Saraswati Vihar, Deepali Chowk, Delhi, near Rani Bagh Police Station. Of course, it proceeds on the premise of action(s)/inaction(s) attributable to the respondent no.2 and its officials. State/Govt. of NCT of Delhi is not a necessary party in the instant proceedings and therefore, is deleted from the array of the respondent.

How are the petitioners concerned with only two of the properties, subject matter of the petition, it was queried from the ld. counsel for the petitioners. In his half-hearted response, he says that possibly, they are the students of law, but, not sure about it. Ld.

counsel for the petitioner on his part submits that as far as he knows with certainty, they are running an NGO.

As per the affidavit accompanying the writ petition, they are 26/27 years of age and it is not a case that they are the neighbourers, who got immediately affected by the construction, allegedly unauthorized. Petition is therefore, disposed off, with the directions to the respondent to treat the instant writ petition as a representation and dispose off the same expeditiously by taking the required action, as may be required under the provisions of DMC Act. Pending application also stands disposed off.
