% 03.09.2024 Learned counsel for the petitioner submits that in the present case charge sheet has been filed. However, learned counsel submits that the purported sanction is in fact totally illegal. After some submissions, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to raise all contentions regarding sanction and delay before the learned Special Judge. Liberty is granted. All contentions have left open. It is made clear that this Court has not gone into the merits of the case and no expression made herein shall tantamount to be an expression of merits of the case. In view of the above, the present petition along with pending applications stands dismissed as withdrawn with the liberty to raise all contentions before the learned Special Judge.
