% 21.10.2016 This petition is filed under Article 227 of the Constitution of India seeking to impugn the order dated 02.07.2015 by which an application under Order 41 Rule 5 CPC was allowed, subject to the condition that the appellant shall deposit 50% of the decreetal amount within fifteen days in the court in the form of FDR.

The matter is lingering on for a long time. None is present for the petitioner.

The learned counsel appearing for the respondent submits that the parties have settled the matter and a part of the settled amount has already been paid by the petitioner to the respondent. In view of the submission the learned counsel appearing for the respondent, nothing survives in the present petition and the same has become infructuous. The petition is dismissed. JAYANT NATH, J.
