% 13.04.2017 After some arguments, the learned counsel for the petitioner submitted that he may be allowed to withdraw the criminal leave petition inasmuch as the State case arising out of FIR No. 196/2012 registered in Police Station Kotla Mubarak Pur under Sections 420/468/471/120B IPC is already pending before the concerned court wherein the respondent Babu Lal has been declared proclaimed offender by the Metropolitan Magistrate by order dated 18.3.2017. At the same time, he submits liberty may be given to the petitioner to assist the public prosecutor representing the State in the case arising out of the police report (the State Case). Liberty, as prayed, is granted. The assistance to the public prosecutor in charge of the State case, however, shall be circumscribed by law. The criminal leave petition is dismissed as withdrawn.
