% 05.10.2015 By order dated 28.05.2015 the petitioner was directed to be released on furlough for two weeks from the date of his release subject to certain conditions. The aforesaid order of release effected was withheld keeping in view the fact that one of the co-accused of the petitioner who is his real brother had jumped the furlough and did not surrender before the jail authorities in time.
The petitioner in this connection submits that he has been staying separately from his brother.
With reference to the nominal roll, he submits that his overall conduct in jail has been satisfactory and on earlier occasions also when he was released on furlough, he surrendered before the jail authorities, on time. The status report affirms the fact that the wife of the petitioner is in an
advanced stage of pregnancy and is likely to deliver on 12.10.2015. Under such circumstances, the petitioner prays for being released on furlough for a period of two weeks from the date of his release. Let the petitioner be released on furlough for a period of two weeks from the date of his release on his furnishing a bond in the sum of Rs.5000/- with one surety of the like amount to the satisfaction of the Trial Court. The petitioner on being released on furlough, would furnish his mobile telephone number as also the mobile telephone number of his surety to the SHO of the concerned police station. The petitioner shall not go out of the National Capital Region without informing the SHO of the concerned police station. The petitioner shall surrender before the jail authorities after the expiry of the period of furlough. In case the petitioner involves himself in any unlawful activity during the period of furlough, it would be open for the SHO to have the present concession withdrawn. The petition stands disposed of.
