CM APPL. 47070/2016 (for extension of time to vacate suit premises) 1.

The present application has been filed by the appellant praying inter alia for extension of time by four weeks to vacate the suit premises. 2.

It may be noted that the appellant had himself volunteered to vacate the suit premises on or before 31.12.2016, and it was only on the said condition that a settlement was recorded by the predecessor Bench in the order dated 18.8.2015. Now that less than one week is left for the agreed period to expire and the suit premises to be vacated, the present application has been filed by the appellant stating inter alia that the time for vacating the suit premises be extended by four weeks.

There is no justification for the appellant to approach the Court at the eleventh hour for seeking extension of time to vacate the suit premises. The prayer made in the application is declined, as being devoid of merits. 4.

The application is dismissed.
