O R D E R
% 11.10.2017 Learned counsel for the petitioner submits that petitioner is 59 years of age. As per the FIR, four persons between 25 and 30 years had entered in the jewellery shop and had committed robbery. Initially, FIR was registered under Sections 392/34 IPC. The role assigned to the petitioner was that he was receiver of the stolen property.
Learned APP submits that as per the CCTV footage, five persons were noticed at the spot, therefore, offence under Section 395 IPC was added.
The persons who had looted the jewellery shop had given entire jewellery to co-accused Saurav who further sold it to other co-accused persons including the petitioner.
Keeping in view the role assigned to the petitioner and the fact that
investigation is complete and petitioner is in custody for the last three and a half months, it is ordered that petitioner be released on bail, subject to his furnishing a personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial court. Bail application is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
