% 31.10.2018 The impugned order dated 31.08.2018 perused and the same is reproduced below:

"Present :Shri B.S. Mathur, Counsel for Petitioner. :

Shri S.S. Rathi, Husband of R-1.

1. Representative of R-1 requested for adjournment as the counsel is hospitalised. He also file copy of medical certificate.

2. Counsel for Petitioner requested that he is seeking only direction to concerned SDM/RA to dispose off his application

under Order 7 Rule 11.

3. Heard all the parties.

4. Case is remanded back to the concerned SDM/RA for fresh hearing on the application under Order 7 Rule 11 and dispose off the matter as early as possible or within three months. Case is disposed off accordingly.

5. File be consigned to Record Room after completion." The dispute pertains under Order 7 Rule 11 and which is between the Court and the respondents, therefore, nothing survives in the petition. Accordingly, the present petition is dismissed. I.S.MEHTA, J OCTOBER 31, 2018 sr
