% 28.08.2017 Petitioner is aggrieved by the fact that the boundary wall of the petitioner has been demolished by the respondent; submission is that this is for no fault of the petitioner.
On advance notice learned counsel for respondent has put in appearance. He has instructions to inform this Court that the road in front of the property of the petitioner is being widened; it has a width of 25 metre (as of now). Contention of the respondent is that the boundary wall of the petitioner was falling in Khasra No.123/1, Village Mehrauli which is Government land and this had led the Government to demolish this part of the structure. Further submission is that no part of the land of the petitioner will be touched or demolished without due process of law. The property of the
petitioner falls in Khasra No.338 (1 bigha 18 biswas) in the Revenue Estate of Village Mehrauli, New Delhi.
Noting this submission of the respondent, it is clarified and it is made clear that nothing falling upon the land of the petitioner will be touched upon/demolished by the respondent without following due process of law. No further orders are called for in this petition. At this stage, learned counsel for petitioner submits that he has made an appropriate application before the Revenue Assistant on 24.7.2017 seeking a demarcation of his land as his apprehension is that his land again may be touched upon by the respondent. If any such application has been filed before the concerned/competent Authority the same shall be decided within an outer limit of four months from today in accordance with law.
Petition disposed of.
