% 30.10.2017 Present suit has been filed for permanent injunction restraining the breach of confidentiality and fiduciary duty, trade secrets, breach of contract, delivery up and damages.
Learned counsel for the defendant abandons the defence of waiver of confidentiality clause and states that the defendant undertakes not to illegally use or disclose to third parties the confidential data of the plaintiff, if any, in her possession. He further states that all the information pertaining to the plaintiff, if any, in the defendant‟s possession shall be deleted within a period of one week. He also states that the defendant shall voluntarily pay Rs.25,000/- to the Lok Nayak Hospital, New Delhi, within a period of four weeks. The receipt of payment shall be filed with the Registry of this Court within a period of two weeks thereafter.
In view of the aforesaid statement/undertaking, learned counsel for the plaintiff does not wish to press any further relief. The statements/undertakings given by learned counsel for the parties are accepted by this Court and parties are bound by the same. Consequently, the suit is decreed in the aforesaid terms. Registry is directed to prepare a decree sheet accordingly. In the event the defendant has any claim against the plaintiff, she would be at liberty to file the same in accordance with law. It is, however, clarified that this Court has not expressed any opinion on the merits of the controversy and the rights and contentions of all the parties are left open.
