% 14.10.2015 The petitioner had preferred an application seeking grant of anticipatory bail in connection with FIR No.438/2015 (PS Chhawla) instituted for offence under Sections 186/332/353/506/34 of the IPC. According to the allegations levelled in the First Information Report, while the junior engineer (complainant) was instructing the driver of JCB to demolish an illegal construction in an anti-encroachment drive, some persons named in the FIR assaulted him on the instigation of the petitioner. Mr.Anupam S. Sharma, who had also appeared on the last occasion, submitted that he has been appointed as Special Public Prosecutor in the

case and on the instructions of the IO of this case, who is present in Court, submits that there is no move of the police to arrest the petitioner in the instant case.

Considering such statement at the bar, Mr.H.S. Phoolka, learned Senior Advocate appearing on behalf of the petitioner, seeks permission to withdraw this application as there is no longer any apprehension of arrest. It has also been submitted on behalf of the petitioner that pursuant to the interim orders passed by this Court granting protection to the petitioner, the petitioner joined investigation and visited police station as and when he was required.

The permission for withdrawal of the application is accorded. Application is dismissed as withdrawn.
