% 30.01.2019 The petitioner has joined investigations and undertakes to join the same as and when so called by the Investigating Officer. A Status Report dated 27.01.2019 filed on behalf of State records inter alia:- " .....accused/applicant joined investigation and during interrogation he stated that he was deployed as a guard at Akash Educational Services Ltd. Dwarka Mor, B-1/18, Sewak Park near NSIT College Dwarka Mor, Delhi and his duty timings were 8.00 AM to 8.00 PM. As regard to CCTV footage accused/applicant stated that every morning during his duty timings, one sweeper Shintu used to come at the warehouse for cleaning. In the CCTV footage also the same person Shintu is seen loading the bag containing waste in the Rickshaw. Regarding the switching off of CCTV camera, accused/applicant explained that whenever there is electricity failure, CCTIV cameras are automatically switched off and the same was also verified from the complainant and warehouse. He also explained that a register is also being maintained
regarding the date and time of electricity failure but he forgot to record the entry regarding electricity failure in the same on 22.09.2018. Copy of the register was also seized and taken on record.
During the further course of investigation Shintu joined the investigation and stated that he has been given the task to clean the warehouse by one Mr. Raman Kumar who is working/employed in Akash Educational Service Ltd. B-1/18 Sewak Park, Uttam Nagar, New Delhi and he cleans the premises regularly and carries the waste material in his Rikshaw. The facts were also confirmed from Mr. Raman Kumar s/o Sh. Mithan Lal R/o H.No. 1891 GTB Enclave, DDA Janta Flats, Nand Nagri, New Delhi who works as a executive in Aakash Educational Service Ltd. B-1/18, Sewak Park, Uttam Nagar, New Delhi".
In view of the above, the interim protection is confirmed. It is directed that in the event of arrest of the petitioner in case FIR No. 838/2018 registered under section 380 IPC registered at Police Station, Binda Pur, he be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with a surety in the like amount to the satisfaction of the Arresting/Investigating Officer, subject to the following conditions: (i) the petitioner shall continue to participate in the investigations as and when he is so intimated by the Investigating Officer; (ii) he shall make no attempt, directly or indirectly, to contact the complainant or relatives or close associates; (iii) he shall furnish his mobile phone number to the police, which shall be kept operational at all times, so that the police could contact him; (iv) he shall not make any effort to evade the process of law; and (v) in case of change of the phone numbers or address, the petitioner shall inform the police forthwith.
Observations made in this order shall have no bearing on the merits of the case.
