This petition is filed under Section 11 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as 'the Act') seeking appointment of a sole arbitrator.

The learned counsel for the petitioner submits that he would like to drop respondent No.2 from the array of the parties. Respondent No.2 is deleted from the array of parties.

The learned counsel for the parties agreed that there is an arbitration clause in the Letter of Intent dated 23.06.2016. As per the said clause in case of disputes between the parties, the same should be referred to arbitration under the Act.

Accordingly, I appoint Mr.Justice D.P.Wadhwa, (Retd. Judge, Supreme Court of India) (Mobile No.9810720200) as the sole arbitrator to adjudicate the dispute between the parties. The learned arbitrator will fix his fees in consultation with the learned counsel for the parties. The parties are

directed to appear before the learned arbitrator on 25.10.2017 at 04:00 PM for directions.
