% 28.01.2019 A detailed Status Report has been filed on behalf of the State. Mr. Rahul Mehra, Standing Counsel for the State submits that the petitioners' complaint against the police officials is under consideration by the authorities concerned. He also submits that the petitioners are seeking similar relief from the Public Grievance Commission; that in view of the pendency of this writ petition, the complaint of Petitioner No.1, has been disposed off by the Public Grievance Commission, whereas in the complaint of petitioner No.4 Ms. Mehak, there is direction for further inquiries/investigation and the matter has been directed to the Public Grievance Commission (South-East). A detailed report is awaited; the matter has been kept in
abeyance.
The learned counsel for the petitioners refers to the MLC report issued by the All India Institute of Medical Sciences (AIIMS) which records that the patient was conscious, coherent and well oriented about the time and place.
The petitioners' breath alcohol test was conducted; his blood alcohol test reported 52 mg/100 ml alcohol, but the report also records an external injury i.e. small "abrasion over the left forearm with a cut of 3 cm in length, transversely placed over the inner side of the said forearm and as well as a bruise over the right forearm". It was concluded in the MLC report that the said injuries are simple. The learned Standing Counsel for the State submits that Delhi Police will take appropriate steps, the matter will be looked into by the Vigilance Department. Any development shall be intimated to the petitioners within a period of eight weeks.
The present petition is accordingly disposed off, in the above terms.
