% 10.11.2016 C.M. 26334/2016 (u/s 151 CPC) This is an application filed under Section 151 CPC by the appellant seeking restoration of appeal which was dismissed in default vide order dated 18.07.2016.

The appeal has been preferred by the appellant challenging the order dated 13.07.2015 passed by the learned Addl. District Judge whereby petition filed by him was dismissed.

A perusal of memo of parties goes to show that besides State, there were three other respondents who have not been impleaded in the present appeal. Learned counsel for the appellant submits that he will implead the respondents as party to the appeal. Amended memo of parties be filed within a week from today and thereafter notice be issued to the them on taking necessary steps on filing PF, speed post, courier, returnable on 31st January, 2017.
