% 10.01.2019 CM APPLN. 46225/2018 I find no ground to allow the present application. The same is accordingly dismissed.

W.P.(C) No. 11927/2018 Vide order dated 07.12.2018, last opportunity was granted to the respondents to file counter affidavit within 10 days, failing which the counter affidavit shall be accepted with cost of ₹25,000/- each. The respondent no.2 failed to do so within the time granted by this Court.

Accordingly, the said respondent is directed to deposit the amount of Rs.25,000/- as cost to the Delhi High Court Legal Services Committee within one week.

On deposit of the cost of Rs.25,000/-, counter affidavit of respondent no.2 shall be taken on record. Rejoinder thereto, if any, be filed before the next date of hearing.

Respondent no.3 has not filed counter affidavit despite last opportunity, therefore, his right to file counter affidavit is forfeited. Respondent no.3 is directed to produce the original record regarding the process of the assessment of the petitioner in question on the next date of hearing.
