% 06.12.2018 Notice. Learned APP for State accepts notice. Respondent No. 2/Ms. Jyoti Malhotra is present in court along with her counsel and has been identified by IO/SI Praveen Kumar, Police Station Mandawali, Delhi. Respondent No. 2 states that she has settled the matter with the petitioner of her own free will and without any undue force, pressure or coercion vide the Settlement Deed dated 30.01.2018.
Respondent No. 2 states that her marriage with the petitioner has been dissolved by a decree of divorce by mutual consent dated 10.09.2018 passed by the Family Court, East District, Karkardooma Courts, Delhi. She further submits that entire settlement amount stands paid and she has no objection in case FIR No. 1229/2014
registered under Sections 498-A IPC at Police Station Mandawali, Delhi is quashed.
Affidavit of respondent No. 2 in support of the petition has also been filed.
Keeping in mind the settlement arrived at between the petitioner No. 1 and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending.
Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed. Petition is disposed of.
