After arguments, this appeal is disposed of as not pressed as the counsel for the appellant states that the appellant proposes to amend the plaint for questioning the decision taken in the general body meeting dated 16.4.2017 and also file an application for interim relief. 3.

It is clarified that allowing the appellant to withdraw the appeal because the applications for amendment and injunction are proposed to be filed is not tantamount to this Court making any observation as to the merits

of the application for amendment or merits of any injunction which the appellant/plaintiff claims and which aspects will be dealt with by the concerned court in accordance with law as also the defences raised by the respondent/defendant.
