% 30.08.2017 The instant petition has been filed by the petitioners seeking quashing of FIR No.998/2015 punishable under Section 135 of Indian Electricity Act registered at Police Station - Mehrauli, New Delhi, on the complaint of respondent No.2 and the proceedings pursuant thereto. Learned counsel for the petitioners submits that the petitioners have already settled the matter with the BSES and paid a sum of Rs.3,25,230/- (Three Lakh Twenty Five Thousand Two Hundred Thirty only) and seek the quashing of the aforesaid FIR.

Counsel for the parties submits that they have no objection if the present FIR is quashed as the petitioner has cleared the theft bill amount of Rs. 3,25,230/-.

Statements of counsel for the petitioners and authorised representative of the respondent No.2/BSES have been recorded separately. CRL.M.C. 3415/2017

In view of the aforesaid statements, the FIR No.998/2015 punishable under Section 135 of Indian Electricity Act registered at Police Station - Mehrauli, New Delhi and all the proceedings emanating therefrom are quashed.

The petitioners are, however, burdened with costs of Rs.15,000/- to be deposited with the Delhi High Court Legal Services Committee. Counsel for the petitioners who is present in person undertakes that the cost of Rs.15,000/- will be deposited in the account Section of Delhi High Court Legal Services Committee as it has closed by now as it is 4.45pm.
