By this petition the petitioner seeks bail in case FIR No. 14/2013 under Sections 306 IPC registered at PS Anand Parbat, Delhi. 2.

The allegations of the prosecution against the petitioner are based on the suicide note left by the deceased on which, a report of hand writing expert has been received opining that the hand writing in the suicide note matched with the hand writing of the deceased. 3.

In the suicide note the deceased alleged that the petitioner was blackmailing the deceased even after her marriage. During the course of trial the husband and parents of the deceased have already been examined. 4.

Learned counsel for the petitioner has taken this Court through the statements of these three material witnesses wherein there are some contradictions and the mother of the deceased has even admitted that her daughter used to write letters to other people prior to marriage, she had some BAIL APPLN. 1715/2017

mental problem since childhood and had tried to commit suicide prior to marriage.

Without commenting on the merits of the case, since the material witnesses have been examined and the petitioner is languishing in jail for more than four years being in custody since 14th December, 2013 and the trial is still likely to take some time as formal witnesses are yet to be examined, this Court deems it fit to grant bail to the petitioner. 6.

It is, therefore directed that the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount, subject to the satisfaction of the learned Trial Court, further subject to the condition that he will not leave the country without prior permission of the court concerned and in case of change of address the same will be duly intimated to the learned Trial Court by way of an affidavit. 7.

Petition is disposed of.
