% 04.09.2017 After arguments, this appeal is disposed of as not pressed as it is observed that by the impugned order merits of the matter are not decided finally, and which merits will only be decided finally at the stage of final arguments in the suit after evidence is led by both the parties. Trial court is, however, requested to expedite the disposal of the suit. I may note that appellant/plaintiff states that he proposes to move an application for amendment of the plaint under Order VI Rule 17 CPC, and which application when filed, would be heard and disposed of by the trial court in accordance with law.
