% 18.09.2017 Respondent no.2 is present in the Court with her counsel and has been identified by ASI Jai Bhagwan. She submits that she has settled the matter with the petitioner no.1, in the Mediation Centre, Tis Hazari Courts on 4th April, 2016 vide Annexure 'B'. She admits having received the entire settled amount from the petitioner no.1 and submits that her marriage with petitioner no.1 has already been dissolved by a decree of divorce by mutual consent on 22nd March, 3rd 2017 passed by the Family Courts, West District, Tis Hazari Courts, Delhi. She says that she has now settled the matter with the petitioner no.1 of her own free will, voluntarily and without any undue force, pressure or coercion. She further submits that she is not willing to pursue the FIR 238/2013 under Sections 498-A/406/34 IPC registered at PS Nihal Vihar, Delhi any further and the same may be quashed.
Keeping in view the settlement arrived at between the petitioner no.1 and respondent no. 2 voluntarily, in the interest of justice, FIR 238/2013 under Sections 498-A/406/34 IPC registered at PS Nihal Vihar, Delhi, and consequent proceedings emanating therefrom, are quashed.
