% 03.07.2024 The present petition has been filed seeking quashing of the CC No. 1245/1/15 under Sections 138 read with Section 141 and 142 of The Negotiable Instruments Act, 1881under the Police Station Barakhamba, New Delhi.
Learned counsel for the petitioners submits that there was no specific averment against the petitioners that they were involved in day to day affairs of the company.
Learned counsel for the petitioners seeks permission to withdraw the present petition with the liberty to challenge the same before the learned Sessions Court subject to the permission that the delay in filing the petition before the learned Sessions Court may be condoned. The petitioner is at liberty to file the revision petition before the learned Sessions Court challenging the summoning order. Court shall consider the same in accordance with the law. The period consumed during the pendency of the present petition before this Court is condoned.
In the meantime, the interim protection granted to the petitioner shall remain operative till eight weeks, within this period, the petitioner may approach the learned Sessions Court for filing the revision petition. Accordingly, the present petition is dismissed as withdrawn with the liberty as prayed for.
