% 13.03.2018 After some hearing, the counsel for the petitioners submits that he may be allowed to withdraw the present petition and the application filed therewith as the petitioner concedes to the fact that the plaint cannot be partly rejected and, therefore, seeks liberty, to reserve all the contentions vis-a-vis impermissibility of prayer clauses (a) and (b) and take such objections as would be available under the law in their context at the trial. The petition and the application filed therewith are dismissed as withdrawn with liberty as prayed for granted. Needless to add, the trial Court while considering such objections, as aforesaid, will not feel bound by the view taken in the order dated 02.03.2015 under Order 7 Rule 11 CPC.
