In the above captioned two applications, petitioners seek bail in FIR No.375/2015, under Section 308/34 of the IPC, registered at police station Delhi Cantt., Delhi while claiming to be innocent and in custody since 16th July, 2015.
Learned counsel for petitioners submits that there is delay of 7 hours in lodging the report and the role attributed to petitioners is of throwing brick back at the injured, who had sustained simple injuries. Notice.
Mr. Arun Kumar Sharma, learned Additional Public Prosecutor for respondent-State accepts notice and has placed on record status report in this case.
Upon hearing both the sides and on perusal of FIR of this case and status report placed on record, it is directed that petitioners - Rohit, sb Shri Lekhraj and Nitin Lala, s/o Shri Om Prakashi be released on bail on their furnishing bail bonds in the sum of 25,000/- each with one local surety each in the like amount, to the satisfaction of the trial court/ court concerned.
