Learned counsel for the petitioner states that he could not appear on 8.3.2016, hence the petition be restored, which is not opposed by the State. 2.

The petition is restored.

W.P.(CRL) 1804/2015 1.

The prayer made in this writ petition was for directing the respondent Nos. 2 and 3 to provide protection to the petitioner and for taking action against the accused persons.

Learned counsel for the petitioner submits that since protection was provided as prayed for, now this prayer has become infructuous and petition may be dismissed as infructuous.

Status report has been filed by the Ste to the following effect: W.P.(CRL) 1804/2015

"In this regard it is submitted that both the parties have filed various complaints against each other. During enquiry statements of complainant and other alleged parties were recorded and it has been found that earlier petitioner Sh. Surender Kumar Parasar was deputed as priest and care-taker of the said Temple. Later on he brought his family members & relatives in the Temple and they used to stay in the premises of said Temple. On this the local residents objected for residing his family members in the said Temple. On this issue both the parties levelled false allegation against each other. For maintaining peace in the locality, the preventive action U/S 107/150 Cr.P.C has already been taken against both the parties." 4.

Learned counsel for the petitioner submits that since the protection was provided as needed, now the petition has become infructuous. 5.

The petition is dismissed as infructuous.
