O R D E R

% 01.09.2015 The petitioner seeks anticipatory bail in FIR No.458/215 dated 20.7.2015 instituted for offences under Sections 304/34 of the IPC. The petitioner and one Jitu, who is the brother of the petitioner, are alleged to have assaulted deceased on the streets.

On being informed about such assault the mother of the deceased came to see her son only to find him lying injured on the road. The deceased was taken to hospital from where he was released. Later, when the deceased did not favourably respond to the medication, he was again taken to LBS Hospital. After some time, the deceased died. The post-mortem report discloses that the death was due to Haemorrhagic

shock due to laceration of mesenteric vessels caused by blunt force impact. Considering the allegations against the petitioner as also the fact that another co-accused, who is his own brother, is in custody, the Court is not inclined to release the petitioner on bail.

The application is disposed of.
