% 17.03.2016 I.A. No. 3591/2016 This application has jointly been moved by the parties under Order XXIII Rule 3 CPC to record their settlement. The application is signed by the parties and their respective counsel. It is also supported by the affidavit of Ms. Veena Poolakal, the constituted attorney of the plaintiffs and Mr.Tapan Mehta, the defendant. The terms of settlement appear to be fair, just & reasonable and there is no impediment in accepting the same. Accordingly, the suit stands disposed of as settled in terms of the settlement. Decree is passed in terms of prayers (A) and (B) of the plaint. Since the suit has been settled prior to commencement of trial, the plaintiffs shall be entitled to refund of 50% of the Court Fees.
