% 13.11.2018 Learned counsel for the petitioner submits that role of committing rape has not been assigned to the petitioner. Allegations of rape are against the co-accused Avnish. The only allegation against the petitioner is that he was present in car when Avnish took the prosecutrix forcibly with him. Investigations are complete. Charge-sheet has been filed. Petitioner is in custody for eight months.

Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `20,000/- (Rupees Twenty Thousand Only) with one surety in

the like amount to the satisfaction of the trial court. Bail application is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti. A.K. PATHAK, J.
