The present petition has been filed under Section 482 Cr.P.C. seeking quashing of impugned order dated 27.09.2018 passed by Ld. ASJ-02, Central, Delhi in CC NO. 18/2016 declaring petitioner as proclaimed offender under Section 82(4) Cr.P.C.

Learned counsel for the petitioner submits that the petitioner is regularly appearing before the Ld. Trial Court and attending the trial through counsel in terms of the order dated 30.12.2018. Learned counsel also submits that now even the charges have been framed. 3.

This court vide order dated 03.12.2018 stayed the operation of the impugned order and the petitioner was exempted from personal appearance before the Ld. represented by learned counsel and does not seek adjournment on the ground of his appearance.

It has further been submitted that in terms of this order, the petitioner has been appearing through counsel, and charges have also been framed. Learned counsel submits that the petitioner undertakes to appear before the Ld. Trial court within 08 weeks. 5.

Since the petitioner has been appearing and has not flouted again, the impugned order dated 27.09.2018 declaring the petitioner as a proclaimed offender is set aside.

The petitioner shall appear before Ld. Trial Court and the Ld. Trial Court shall pass an appropriate order in accordance with the law. 7.
