The counsel for the plaintiff seeks return of the plaint for filing in the Court of appropriate pecuniary jurisdiction.

The plaint is ordered to be returned in accordance with law. 5.

The counsel for the plaintiff also states that the relevant provision is Section 109 of the India Succession Act, 1925 and not Section 105 of the Act.

It will be open to the plaintiff to make requisite pleas in the Court where the suit is filed.
