ARB.P. 823/2018 1.
There is a valid arbitration agreement between the parties contained in Clause 33.1 and 33.2 of the tender reproduced in paragraph 17 of the petition. The disputes have arisen between the parties and the petitioner invoked the arbitration vide letter dated 22nd December, 2016 which was not replied by the respondent.

Learned counsel for the respondent submits on instructions that there is a valid arbitration agreement between the parties and the respondent has no objection to the appointment of an arbitrator by this Court. 3.
The petition is allowed and this case is referred to Delhi International Arbitration Centre (DIAC). Delhi International Arbitration Centre shall appoint an Arbitrator to adjudicate the disputes between the parties including their claims and counter-claims, if any
4.
The arbitration shall be conducted under the ageis of Delhi International Arbitration Centre.

The learned arbitrator shall ensure the compliance of Section 12 of Arbitration and Conciliation Act, 1996 before commencing the arbitration. 6.
Copy of this order be sent to the DIAC.
7.
Copy of this order be given dasti to counsels for the parties under signatures of the Court Master.
