% 02.11.2018 CRL.M.C. 5630/2018 Notice. Learned APP accepts notice on behalf of respondent no.1. Respondent no.2 is present in the Court and has been identified by ASI Harbir Singh of police station Sunlight Colony. Respondent no.2 says that he has settled the matter with petitioner of his own free will and without any undue force, pressure or coercion. Petitioner was his friend. A quarrel took place between them on some trivial issue which led to the stabbing incident. Respondent no. 2 submits that he has settled the matter with the petitioner in order to maintain harmonious relations in future. He has no objection in case FIR No.25/2018 under section 307 IPC at police station Sunlight Colony and consequent proceedings emanating therefrom are quashed.
Learned APP has opposed the quashing of FIR on the ground that injuries sustained by the respondent no.2 were grievous in nature. Keeping in mind that a quarrel took place between the friends, that is, petitioner and respondent no.2 on some trivial issue and now that they have settled their disputes amicably, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, aforesaid FIR and consequent proceedings emanating therefrom are quashed against the petitioners. Petitioner is in custody since 14th January, 2018. He be released forthwith, if not required in any other case. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti. A.K.
