Learned APP for the State, on instructions from the Investigating Officer, submitted that the respondent Nos.2 to 4 have already been granted regular bail by the Trial Court. Hence, the present petition for the cancellation of the anticipatory bail has become infructuous.

Learned counsel for the petitioner submitted that in view of the statement of the learned APP, he may be allowed to withdraw the petition with liberty to file an application for cancellation of regular bail granted to the respondent Nos.2 to 4.

Learned counsel for the petitioner further submitted that he is under the bona fide belief that the IO did not inform the Trial Court regarding the pendency of the present petition.

Learned APP, on instructions from the IO, submitted that in the charge-sheet, the respondent No.1 has already mentioned about the pendency of the petition before the High Court. 5.
Accordingly, the petition is dismissed as withdrawn with the liberty as prayed for.
6.
It is clarified that this Court has not expressed any opinion on the merits of the present petition.
