O R D E R

% 04.12.2018 The petitioner seeks parole for a period of three months to take care of his ailing mother, who is about 80 years of age and is suffering from various age related chronic ailments. He also seeks to re-establish social ties with society and family members and to arrange funds for the latter. His application for parole was dismissed by the State by order dated 04.09.2018 on the ground that he has already availed two weeks' furlough in the month of May-June, 2018. The factum of ailment of his mother and his address have been verified. The petitioner is undergoing life imprisonment. He has been incarcerated for more than 11 years 10 months 25 days. He has earlier been granted parole thrice and furlough nine times and has never misused the liberty granted.

In view of the foregoing, the Court finds no impediment in allowing the present petition. Consequently, the petitioner is granted parole for a

period of six weeks from the date of his release on his furnishing a personal bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the Jail Superintendent concerned subject to the following conditions:-

(1) The petitioner shall report to the SHO concerned Police Station, Punjabi Bagh, Delhi, once a week, on every Tuesday during the period of parole.

(2) He shall furnish his telephone number, which he undertakes to keep operational at all times, to the SHO concerned.

(3) He shall not leave the territory of NCT of Delhi.

(4) The petitioner shall surrender before the jail authorities at the expiry of the period of parole.

With the above directions, the Writ Petition is disposed-off. A copy of this order be given dasti to the learned counsel for the parties under the signature of Court Master. Additionally, a copy shall also be delivered upon the Jail Superintendent concerned through the police. NAJMI WAZIRI, J DECEMBER 04, 2018 RW
