% 05.12.2016 Learned counsel for the petitioner submits that the petitioner has amicably settled with the respondent in execution proceedings and therefore, the petitioner may be permitted to withdraw this petition and the amount deposited by the petitioner be refunded back. Since the respondent has not yet been served notice to the respondent, petitioner's prayer can be entertained without notice to the respondent. The writ petition and the pending application are dismissed as withdrawn. The ex parte interim order dated 26th August, 2015 is vacated. The amount deposited by the petitioner along with interest accrued thereon be refunded back to the petitioner.
