Sushant Gambhir & ORS. v. Mrj Infratech Limited & ORS.
$~14 * IN THE HIGH COURT OF DELHI AT NEW DELHI + O.M.P.(I) (COMM.) 436/2018 SUSHANT GAMBHIR & ORS.
..... Petitioners Through None versus MRJ INFRATECH LIMITED & ORS.
..... Respondents Through Mr. Madan Gera, Adv.
CORAM:
HON'BLE MR. JUSTICE RAJIV SHAKDHER
O R D E R
% 13.02.2019 1.
There is no representation on behalf of the petitioners. 2.
Mr. Gera, who appears on behalf of the respondents, says that an Arbitrator has already been appointed by the Court. 3.
In this petition, on 22.11.2018, a conditional interim order was passed.
4.
The condition imposed on the petitioners was to deposit a sum of Rs.36.24 crores.
4.1 It is based on this condition that on behalf of the respondents, Mr. Gera had made a statement that they would not transfer, alienate or encumber the subject property till the next date of hearing. 5.
The petitioners' record shows that the petitioners failed to make the deposit in terms of the order dated 22.11.2018. 5.1 As a matter of fact, an application for extension of time was moved O.M.P.(I) (COMM.) 436/2018
which was dismissed by me on 13.12.2018 for the reasons stated therein. 6.
Thus, having regard to the aforesaid facts and circumstances, it appears that the petitioners are no longer interested in pressing the captioned petition.
7.
The petition is, accordingly, closed.
