% 14.12.2018 By this petition, the petitioner seeks bail in case FIR No. 231/2018 under Sections 308/324/34 IPC wherein later Section 307 IPC and Section 25 and 27 of the Arms Act were also added registered at PS DBG Road. The above noted FIR was registered on the complaint of victim Rishabh who stated that on 20th September, 2018 he was celebrating his birthday with his cousin at Ajmal Khan Park. Two boys came and one boy pointed out towards him. These two boys who came were identified as Ajeet and Govind. Later other accused also came to the spot and started beating him. It is alleged that Pradeep stabbed the victim on his left thigh and Tarun was hit by brick by accused Govind. He started bleeding profusely and thus the accused ran in panic.

From the statement of the injured victim no specific role has been attributed to the petitioner herein, namely, Ajeet. Further after investigation charge sheet has already been filed.

Though charge sheet has been filed till date the Investigating Officer has not bothered to collect the final opinion on the MLCs of the two victims. Considering that the nature of the weapon used was a knife and that the injuries were primarily bruises and laceration as also a stab injury on the left thigh which is attributable to Pradeep, this Court deems it fit to grant bail to the petitioner.

It is therefore directed that the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount, subject to the satisfaction of the learned Trial Court, further subject to the condition that in case of change of residential address the same will be intimated to the learned Trial Court concerned by way of an affidavit.

Petition is disposed of.
