O R D E R
% 06.11.2015 The petitioner is aggrieved by the communication dated 10.07.2015 whereby he has been informed that his prayer for being released for the first spell of furlough has been rejected on the ground of adverse police report and further for his having jumped parole, way back in the year 2009. The communication referred to above noticed that while the petitioner was on parole w.e.f. 28.04.2009 to 01.06.2009, he jumped the parole and was rearrested in another case. The communication further refers to the fact that the petitioner has undergone imprisonment in two other cases and is a habitual criminal.
The nominal roll of the petitioner discloses that he has remained in jail for about more than 121⁄2 years and his overall conduct in the jail has been satisfactory. He was punished in the year 2008. The two cases which
have been lodged against him are of the year 2005 and 2010 respectively. The petitioner in the aforesaid two cases has served the sentence imposed upon him. The status report harps on the tainted background of the petitioner.
In any view of the matter, considering the long period of incarceration of the petitioner and his overall conduct in jail, petitioner is directed to be released on furlough for a period of three weeks from the date of his release on furnishing a bond in the sum of Rs.5000/- with one surety of like amount to the satisfaction of the Superintendent of the concerned jail. The petitioner shall on completion of the period of three weeks of furlough shall surrender before the jail authorities. The petitioner shall, before being released, furnish his and his surety's contact number to the Superintendent of the concerned jail.
A copy of this order be sent to the concerned jail superintendent for information and compliance.
Petition stands disposed of.
